Hansen-Mueller Co, an Omaha, NE-based grain trading, merchandising and storage company, filed for Chapter 11 protection on Nov. 17 in the U.S. Bankruptcy Court for the District of Nebraska.
The filing was precipitated by the Nebraska Public Service Commission's temporary suspension of the company's grain trading license on Oct. 24, which created a "domino effect" of pressure from other state regulators and creditors. This regulatory action severely hampered a prepetition marketing process run by investment banker Ascendant Consulting Partners, which began in September and had generated interest from over 33 parties.
The company states it has struggled financially due to several unsuccessful projects, including a pasta plant conversion and a proprietary software development that resulted in combined losses of approximately $26 million, and ultimately ran out of working capital. The Chapter 11 case is intended to facilitate an expedited sale of the company's assets and will be funded by the consensual use of cash collateral from its prepetition secured lenders, led by BMO Harris Bank as agent, which are owed approximately $50.9 million.
Hansen-Mueller Co reports $100 million to $500 million in both assets and liabilities. The filing indicates that there will be funds available for distribution to unsecured creditors. The case number is 25-81226.
